The Ancestry of Spence Franklin Hearn

William Hearn b. 1627 original immigrant

Few things in my life have brought me the joy, or helped me through the trials of living like doing my genealogy. There is real joy in searching all of my lines, but a special bond has grown for me with my Hearn ancestors.
It has been a very interesting trip traveling with them from Maryland, to North Carolina, on to Tennessee, then Arkansas and ending up in Texas. I would love to hear from others who might connect with these lines, so we can share our information.
It seems logical to me to begin this record with my grandparents and work my way backward. My Hearn line merges at several points and this is the easiest way for me to understand the generations. I, in no way presume all of the information contained within is 100% correct, but in many cases I have sought and found documents to support my findings.
I know there will be some information in this document that many will take issue with, especially concerning the parentage of Purnell Hearne. This is a problem I have researched for many years and I now feel I have the solution to the problem that existed. I welcome all information that may affect the findings about this family.
This page is dedicated to the loving memory of my dad, Spence Franklin Hearn.

There is a will in Somerset Co, Md for William HEARNE stating William's brother Ebenezer was made the guardian for William's son James, and William's brother George was made the guardian of William's son Purnell. When George left Maryland he took Purnell with the family. Purnell is not listed as one of George's children in George's will. This leaves me to assume that Purnell is really the son of William and Susana.

There is also proof that Thomas HEARNE married Sarah NEWBOLD, born 1 Nov 1691. She is mentioned in the will of her father, Thomas NEWBOLD as being the wife of Thomas HEARNE. Thomas NEWBOLD will dated in 1713. No marriage record of either marriage has been found yet, nor has a death record of either wife. One might assume that Thomas could have been married to both, perhaps he married Sarah NEWBOLD first and she died after the death of her father. The actual birth dates for all their children are not known either. I have seen a record that lists a marriage date of 31 May 1691 for Thomas, but that is impossible because he has an official birth record in Somerset Co, Md of the same date.

BIOGRAPHY OF RUFUS D. HEARN

This is an article sent to my family from an old Arkadelphia, Arkansas newspaper. I found it in an old box of pictures. The date is July 30, 1964. I do not know the name of the paper, but I am going to print the article because of its importance to the Hearn genealogy.

Rufus D. Hearn - A Dedicated Jurist

by Farrar Newberry
As remembered by a few Arkadelphians of today, sixty-seven years after his death, our subject was a slender, thin-faced man with a heavy, dark red mustache and chin whiskers more on the order of a goatee than a full beard. Though rather shy, perhaps even timid, and never a "hail-fellow-well-met," he was nevertheless affable and courteous, and it is said that persons who hear him talk rarely forgot the experience.
Rufus D. Hearn was born in Sumner County, Tennessee on March 20, 1842. His father, William, and his mother, Ellen Johnston Hearn, were born, reared and died in nearby Wilson County, to which the grandparents on his father's side had emigrated in 1800.
Of an inquisitive mind, the lad was able, by working between sessions, to obtain a fair education in his native Tennessee. Early in life he determined to become a lawyer and to live in a place where opportunities for success in that profession might be found. An older cousin, Alfred G. Hearn, himself a lawyer, had come to Clark County in 1850, and Rufus followed nine years later, when he was seventeen.
The young man was soon able to find employment while pursuing his studies. It wasn't long before he was teaching in a private, or subscription, school in Arkadelphia and this became the way by which he could consistently pursue his preparation for the practice of law.
The process, however, had to be discontinued two years later for by 1861 the war-drums were sounding, and Rufus Hearn heeded the call to arms. He enlisted in the Clark County Light Artillery, and it turned out that he was to fill a place in the Confederate cavalry operating east of the Mississippi throughout the four-year conflict. He participated in the battles of Shiloh, Atlanta, Kennesaw Mountain and Chicamauga. His battery fought under Joe Wheeler, Wade Hampton and Nathan Bedford Forest. In 1863 he was taken prisoner in a cavalry engagement at Shelbyville, Tenn., but escaped. He was wounded and captured again newr Knoxville, but again got away and rejoined his company at Oxford, Ga.
Hearn was a member of the cavalry unit which served as a bodyguard to Jefferson Davis and his family after the break-up of the Confederate government, on the way from Greensboro, N. C. into Georgia. He related many years later that just before the group reached Washington, Ga. the remaining coin in the Confederate treasury, which has been estimated by many writers since that time as running into the millions, was divided among the soldiers and that each received $13, and that in Mexican silver!
After the capture of President Davis, Hearn made his way back to Arkadelphia. He was practically penniless, but anxious to resume his studies and become a lawyer. He continued to teach, and for a while conducted a school for boys only. When the first "free" school, sponsored by the Carpetbag regime, was opened in 1870, he became one of its instructors, and may even have been its principal. Unfortunately the school board minutes for the first two years are missing. We know that for at least a year he taught without being currently paid, waiting until tax money would be available; for the 1873 board record shows a payment to him in the sum of $600, which evidently was his annual salary.
Even after admission to the Arkadelphia bar in 1873 Hearn continued to teach for some five years, thus supplementing the meager fees available to a struggling young barrister of that fargone day. In 1878, however, he offered himself as a candidate for Prosecuting Attorney of the eighth judicial circuit and was happily successful. He was to retain this office for eight years, until, in 1886, he was elected Circuit Judge a place he held continuously until his death eleven years later.
Judge Hearn was a dedicated jurist according to every estimate made by persons who were contemporary with him. A rather solemn man by nature, he brooked no foolishness in his courtroom and was rarely seen to laugh during trial proceedings, no matter what the provocation. My father, who was circuit clerk during the 1890's told me of an incident which illustrates this statement. Dad was seated in a rickety old chair in the courtroom while a serious matter was being adjudicated. Suddenly the chair collaped with a disturbing crash. Greatly embarassed, he got to his feet amid the tittering and confusion and said, "It was an accident, Judge." Hearn, with no trace of a smile, replied, "I see it was. Proceed with the business gentlemen."
Judge Hearn never lost interest in education. When, in 1890, a group of citizens campaigned for funds with which to found the Arkadelphia Methodist (now Henderson State) College, he contributed generously and solicited many other to do the same. He was made a member of the Trustees' Building Committee which supervised the construction of the magnificent four-story edifice that was to house all departments of the college until it burned to the ground in 1914.
Rufus Hearn had joined the Methodist Episcopal Church South at Good Hope, in Wilson County, Tenn., when he was thirteen years old, and remained an active participant of that faith for the rest of his life. He was a steward in the Arkadelphia church and active in the erection during the early 1870's of the handsome frame building which served the congregation until the present brick structure went up on the same site in 1907.
Mr. Hearn, at thirty-three, was married to Bettie E., daughter of his cousin Alfred G. Hearn, on September 1, 1878. Two children, Wilfred and Sallie, came to bless the union, and a devoted family life ensued. It is interesting to note that his will, made more than twenty years after the marriage, named Bettie as executrix to serve without bond, and left all his property to her, except the family piano, which would go to Sallie, and his law library for Wilfred. It is interesting, too, to note that Wilfred and Sallie's sons became lawyers.
R. D. Hearn died at his home, which is still standing at 302 N. 8th Street, on Dec. 2, 1897. He was buried in Rose Hill Cemetery. The Southern Standard said of him? "In all the various relations of life, Judge Hearn uniformly acquitted himself nobly and well. As a citizen he was partiotic and useful; as a soldier he was courageous and dutiful; as a judicial officer he was scrupulously conscientious, painstakingly and rigidly just, clean and pure in the discharge of duty as his judgment directed his course; as a husband and father he was a model, and as a Christian he was practical and consistent. We deplore his passing, and with his many, very many, friends we share with the bereaved family their irreparable loss."
