WHAT IS IT ABOUT TASMANIA AND DYSFUNCTIONAL LAND TITLING?
Tasmania, although a peaceful and appealing state, has a disturbing history
including the genocide
of the majority of its aboriginal population and also a persistent history of
land fraud and land title dysfunction. This web page does posit a link
between genocidal
societies and dysfunctional land tenure and it is acknowledged that this is a
radical view. It is also radical to suggest that overtly Tasmania can appear to be
a calm and peaceful place while at the same time a hidden land grab is
occurring over control for the state's land title registry. However a perusal
of
the many anomolous registrations included in these pages would have to make
the
ordinary person ask questions about the quality and nature of our land title
system.
It is also admitted that the concepts addressed are difficult both to explain and
to understand and the author will accept with gratitude any corrections or counter
arguments.
WHAT ARE LAND SCAMS?
We've all heard of land scams particularly big ones like Whitewater but
we know very little about how they work. Most land scams are achieved by simple manipulation of
the official records of title. Although land scams inevitably cause
investors to lose money (pensioners buying Florida
swamp land for example) this page does not concentrate on these overt
effects of land scams but the mechanics of the land scam iself.
DO I REALLY OWN THE PROPERTY I AM SLAVISHLY PAYING OFF?
Possibly not. Ownership depends on the clarity of the land law and the effectiveness
of the land titling processes in registering clear interests in land. Certain ownership of land
has historically been more uncertain than most persons could imagine - mainly due
to the natural limitations on the ability to maintain large amounts of paper records
and file them effectively. Many land titles are affected by unusual interests such as
ineffectively discharged mortgages, parallel ownership of the same parcel and retained original
deeds. Generally we don't recognize this problem however and therefore we tend to overlook the role played by these
complex hidden interests in land on our economic, social and political lives. Once we realize that
in many cases the "clear" title is either a myth or a form of mass delusion, then we are in a better
position to address the many problems, including widespread corruption and increase in crime which
results from these parallel land tenure systems. The best way to understand dysfunctional land tenure
is to examine the visible tip of the problem - the land scam.

CAN BUYING A HOUSE CAUSE ME PROBLEMS?
Yes, in some areas it can. In many parts of the world, land registration has become so subverted by mistake and
fraud that land tenure itself has unravelled. In other words the general belief that land tenure is stable is a kind
of popular delusion. In this situation many problems arise because interests on land are
uncertain. Those intending to purchase land should ask their local Land Title Office for a copy of the protocol or
system design which governs how land titles are processed so that you can make up your own mind as to the integrity of the
land tenure system.
BUT LAND TENURE SEEMS THE MOST BORING SUBJECT IMAGINABLE!
True. But those who do understand how these land title systems can be manipulated can end up controlling you the
suburban householder. There is a serious worldwide problem of the "criminalizing" of land title registries. This has arisen
for a variety of reasons including computerization and improvements in copying technology and lack of constraints on banking
practices. The control of land tenure by organized crime is usually effected by exploiting weaknesses in the land registration
system which allow the revival of old underlying deeds and titles. This controlling of land tenure by organized crime elements
can occur in any country or state in the world and the control can be achieved by groups outside the targeted state.
