SZAKALY v. SMITH

Supreme Court of Indiana

Property owners brought action seeking determination that they had easement over neighbor's land. The common granters granted an easement of right-of-way in 1956. Subservient deed recorded in 1957 did not contain any reference to easement. The Supreme Court held that neighbor had constructive notice of easement encumbering his tract through disclosure of easement in his chain of title.
